Terms & Conditions
These terms govern the excavation and septic services provided by Dylan Busey & Co Excavation ("we," "us," or "the contractor"), based in Mayetta, Kansas. By contacting us, requesting an estimate, or scheduling work, you agree to these terms.
1. Estimates and quotes
Any estimate or quote we provide is based on the conditions we can observe at the time we look at the job, including the ground, the access, and what is visible on the surface. Soil conditions, rock, groundwater, buried obstructions, and weather can change the scope and cost of a job once work begins. If we encounter conditions that change the work, we will stop and tell you before continuing. A quote is a good-faith estimate, not a guaranteed fixed price unless we put that in writing.
2. Permits, inspections, and locates
Septic systems, sewer lines, and certain site work require permits and inspections from the county or local authority. We coordinate the work with the county, but the property owner is responsible for any permit fees the county sets and for ensuring the property is eligible for the work. Before any trenching for buried utilities, we call in the utility locate. We do not dig blind on a buried line.
3. Site access and preparation
You are responsible for providing reasonable access to the work area for our equipment and trucks, including a clear route in and out. You are responsible for marking any underground lines, sprinklers, or obstacles you know about that are not covered by a utility locate. We are not responsible for damage to unmarked items in the work area.
4. Payment
Payment terms for each job are set out in the quote or agreement we provide. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept payment by the methods listed on your invoice. Past-due balances may be subject to additional charges.
5. Weather and scheduling
Excavation depends on the ground and the weather. Wet, frozen, or otherwise unsuitable ground conditions may require us to reschedule work for safety and quality reasons. We will communicate any scheduling changes as soon as we can. Our hours are Monday to Friday 8:00 AM to 6:00 PM and Saturday 8:00 AM to 12:00 PM; we are closed Sunday.
6. Changes to the scope of work
Any change to the agreed scope of work must be agreed to in writing before the additional work is performed. Changes may affect the cost and the timeline. We will not perform additional work without your approval.
7. Limitation of liability
To the fullest extent permitted by law, our liability for any claim arising out of the work is limited to the cost of the work performed. We are not liable for consequential damages, delays caused by weather or ground conditions, or issues arising from work performed by others on the site.
